Indecopi is nominated for an award from the George Washington University in the United States

The National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi) reported that he has been nominated for the award Antitrust Writing Awards 2022 organized by the George Washington University Center for Competition Law in the United States and the magazine Concurrences.

The nomination is due to the issuance of two guidelines that promote competition for the benefit of consumers, approved by the Commission for the Defense of Free Competition in 2021.

These are the “Guidelines on compensation for damages caused to consumers as a result of anti-competitive conduct” and the “Guidelines for the Calculation of Notification Thresholds” for companies seeking to merge, within the framework of the new merger control regime.

The institution announced that both initiatives have been nominated in the category soft law, which rewards the best initiatives of the world’s competition agencies, which promote free competition in their respective jurisdictions.

On the nominated initiatives of Indecopi

Regarding the “Guidelines on compensation for damages caused to consumers as a result of anticompetitive conduct”, approved in April 2021, regulate the faculty of the Commission to promote compensation claims before the Judiciary to financially compensate consumers who have suffered damages derived from anti-competitive conduct.

The document paves the way for Indecopi to file collective lawsuits in favor of affected consumers, reaffirming that the defense of free competition does not only imply fining companies that incur in anticompetitive conduct, such as cartels or illegal agreements, but also involves compensation for consumers who have been harmed.

For their part, the “Guidelines for calculating notification thresholds”, were issued within the framework of the implementation of the merger control regime in Peru, in force since June 2021.

These guidelines develop the elements that must be considered by economic agents and the authority to calculate notification thresholds, which fulfill the essential function of determining whether an operation must be notified and evaluated by Indecopi.

This is the fourth nomination of the Antitrust Writing Awards for the institution, which also won the first prize for best soft law by the “Leniency Program Guide” in the 2018 edition.
