The decision to join the National Civil Service Authority (Serving) the Ministry of Labor and Employment Promotion (MTPE) would be a mistake and would have negative effects on the agency’s work, warned Andrés Corrales, Development Manager of the Graduate School of the Continental University.
Corrales explained that the initiative would be a mistake because the main objective of the MTPE is to ensure the rights of workers, while Servir’s is to improve human resources care for citizens without neglecting the servers.
“The Constitution says that State servants are at the service of the nation, so administrative law is applied to them and they have different restrictions and sanctioning procedures. Attaching it to the MTPE would mean focusing solely on labor rights, making invisible the reason for the Civil Service, which is service to citizens. Therefore, the sectoral scope must be the PCM”, he emphasized during his participation in a debate organized by the Continental University.
Along these lines, Mayén Ugarte, former Secretary of Public Management of the PCM, also stated that the impact of ascribing would be negative in both cases since the different nature of the public function would be lost sight of, in addition to the fact that it could affect the composition of its board of directors and its court in the medium term.
“The Civil Service exercises administrative power (ius imperium) and the effect of its decisions is not given to an organization, but to all citizens. We must seek balance and place Servir within the framework of a larger objective (the modernization policy of the State) and that is best achieved by being in the PCM”, he pointed out.
Strengthen to Serve, regardless of where you are attached
For his part, the former Minister of Labor Fernando Cuadros Luque maintained that, regardless of where it is attached, what is needed is its strengthening and not weakening it, much less disappearing it, as some labor sectors propose.
“It is essential that there is a technical and specialized entity in the management of human resources and it must be strengthened. However, I think To serve it must position itself better in its role as stewardship of human resources management and must begin to show tangible results”, he concluded.
