Congress approves changes to the law for the return of Fonavi contributions

This Wednesday, the Plenary of Congress approved with 111 votes in favor and 3 against, the autograph that guarantees compliance with Law 31173 for the return of money from the National Housing Fund (Fonavi) to the workers who contributed to it.

In short, the autograph of the law makes changes to the law approved in April of last year for immediate compliance, since after 9 months the process for the return of contributions has not been executed.

In detail, it is determined that the calculation of the refund will be the amount of the contribution of each phonavista adapted to the Consumer Price Index (CPI); that is, current inflation. With which a total of S / 42,008 million is estimated to be returned.

“The amount to be returned is not a calculation of unpayable amounts, but is the amount resulting from the liquidation of Fonavi resources for up to the amount of S / 42,008 million when considering the liquidation of Fonavi assets and those that were acquired with resources of this. No expenses are incurred from the public treasury ”, stated Silvia Monteza, president of the Economic Commission.

It should be noted that the calculation had previously been established based on the value of the contributions, the CPI and added the amount of the legal interest rate. On this, the Ministry of Economy and Finance (MEF) pointed out that it was unfeasible since it amounted to around S / 3.835 trillion, which represented 50 times the GDP of China.

Another change falls on the number of members of the Ad Hoc Commission, the group in charge of executing the process of returning Fonavi contributions.

With Law 31173 it was established that the commission be headed by four members of the National Federation of Fonavistas of Peru (Fenafp), two from the MEF and one from the Social Security Normalization Office (ONP). Measure that was rejected by the Executive Power and did not appoint its representatives, which did not initiate the return process.

Along these lines, the autograph approved today in plenary states that there will be three members of the MEF, one from the ONP and three from the Fenafp. With this, an immediate installation of the working group is sought.
