Affiliates of the Private Pension Fund Administration System (AFP) could withdraw up to S / 18,400 (4UIT) from their individual capitalization account, according to a bill by the congressman of Podemos Peru José Luna Gálvez.
The legal proposal seeks to authorize in an extraordinary and optional way the withdrawal of funds from the AFPs to the insured in order to grant them “greater economic liquidity in the context of the health emergency” due to COVID-19.
In this way, the initiative presented on January 10, 2022 states that affiliates who have not made contributions for at least three consecutive months may optionally withdraw up to 4UIT (S / 18,400) of their total accumulated funds. Meanwhile, the insured who register contributions may withdraw a maximum of two UIT (S / 9,200).
Modality of withdrawal of the AFP
The affiliates may submit their request remotely, virtual or in person, and, only once, within ninety calendar days after the entry into force of the regulation of the law.
Likewise, the bill states that “up to one (1) UIT will be paid every thirty (30) calendar days, and the first disbursement will be made 30 days after submitting the request to the private pension fund administrator to which affiliate belongs. This is applicable until the second disbursement and the rest will be delivered in the third ”.
On the other hand, the norm also contemplates that the funds will be intangible, that is, they may not be subject to discount, legal or contractual compensation, among others.
