Osiptel declares Entel’s appeal unfounded and confirms fines of more than S / 1 million

The Supervising Agency for Private Investment in Telecommunications (Osiptel) declared unfounded the appeal filed last September by the company Americatel Peru SA, belonging to the Entel Group, and confirmed two fines against it for 240.5 tax units (UIT), equivalent to S / 1 million 106,300.

Through the Directing Council Resolution No. 260 -2021-CD / OSIPTEL, the supervisory body confirmed a fine of 127.3 UIT in Item 9 of the Regime of Infractions and Sanctions of the General Regulation of Rates, approved by means of Resolution of the Board of Directors No. 060-2000-CD / OSIPTEL for the breach of article 12 of the referred regulation.

In detail, the sanction is due to the fact that in January 2020 the teleoperator did not comply with informing its customers of the rate increase at least 10 calendar days before its entry into force. Thus, 461 subscribers did not receive the notification by physical letters, 17,097 by email and 3,482 by SMS. In addition, 293 users did not receive the communication because on the date on which the tariff readjustment was carried out, they had the line suspended or dropped.

Likewise, the Osiptel confirmed a second fine of 113.2 UIT for the commission of the serious infraction typified in literal a) of article 7 of the Regulation of Inspection, Offenses and Sanctions, approved by Resolution No. 087-2013-CD / OSIPTEL, at Failure to deliver the information required on a mandatory basis and within the peremptory period established in letter No. 500-GSF / 2020, as well as submitting incomplete information regarding the requirement made on a mandatory basis and within a peremptory period established in letter No. 984-GSF / 2020.
