Its about PL-00457/2021, which seeks to benefit individuals and small businesses that have been affected by the pandemic, and that in no case have received another type of program from the State.
According to Margot Palacios’ proposal, individuals and mypes with current debts with commercial banks and / or with the Financial System Companies (ESF) may request the BCRP to purchase their debts and reschedule their subsequent payment, “Provided that, as of February 29, 2020, as indicated in Resolution 11356-2008-SBS, they register a normal risk rating or with a potential problem”.
For this, the credit histories with Mortgage Guarantee and personal, card, consumer, vehicle, micro and small business loans up to S / 300,000 will be taken into account.
“The limit amounts indicated are those that correspond to the capital owed on 02/29/2020, compensatory or late interest or other subsequent costs are not computable for this purpose. The guarantors, guarantors and guarantors are also beneficiaries of this law. The Banco de la Nación and Agrobanco are not exempted from this rule ”, says the project of the congresswoman of Perú Libre por Ayacucho.
Once the debts are purchased, the BCRP will have a one-year grace period to pay them. In the case of loans with a mortgage guarantee, the debts may be rescheduled for a minimum of one year, and a maximum of up to double the time that had the remaining term on February 29, 2020, with a maximum limit of 15 years. For consumer, personal, credit card, micro, small business and vehicle loans; they may be rescheduled for a minimum of six months, and up to five years.
“Debtors may freely define said terms. The BCRP will have an advisory function for this purpose ”, explains the draft Margot Palacios.
That is not all, because in case the debt has entered a litigation process, defaulters may request the BCRP to purchase judicialized debt. The compensatory rate for the beneficiaries for the purchase of debt by the BCRP will be a maximum of 1.40% per year, for the entire term of the rescheduled debt until its complete cancellation.
