The government of President Pedro Castillo promulgated the Law No. 31388, law that extends the validity of the comprehensive mining formalization process, in order to allow small miners and artisanal miners registered in the Comprehensive Mining Formalization Registry (Reinfo) to have more time to become law.
According to the norm, the formalization of small mining and artisanal mining activities is declared of national interest. Thus, the term of the formalization process will end on December 31, 2024.
During the term of this formalization process, the Executive Branch, through the Multisectoral Working Group, must conclude the process of preparing the National Multisectoral Policy for Small Mining and Artisanal Mining and develop the necessary actions for its implementation.
In accordance with the norm, the Executive, through the Ministry of Energy and Mines (Minem) has a period of 180 working days, counted from the day following the publication of the law, to present to Parliament the proposed normative Law of Small Mining and Artisanal Mining.
The legislative initiative had been approved by Congress in mid-December. The Executive could enact it, return it or not pronounce, but chose the first. The document has the signature of President Pedro Castillo and the head of the Council of Ministers, Mirtha Vásquez.
It should be noted that, after the approval of the project in Congress, the Ministry of the Environment warned through a statement that this measure does not ensure the application of environmental or social safeguards.
