The Executive Power ordered to extend the validity of remote work for the public and private sectors, approved within the framework of the health emergency by the COVID-19, until December 31, 2022.
In addition, the measures established for the compensation of hours in cases of leave with enjoyment of remunerations granted to civil servants of public entities, which due to the work they perform do not apply to remote work.
With this legal device, Title II of Emergency Decree No. 026-2020 is extended, which establishes various exceptional and temporary measures to prevent the spread of the Coronavirus in the national territory, regulates the modality of remote work, applied in a mandatory way to workers considered in the risk group for the duration of the health emergency by the COVID-19.
The Executive argues that this work modality is being expanded, given that the country is currently in the context of starting a third wave of COVID-19, due to the appearance of new variants of this virus.
The norm specifies that in the face of the economic problems derived from the COVID-19 pandemic, the measures applicable to remote work constitute regulations in economic and financial matters, as they contribute to increasing labor productivity and reducing risks for the preservation of the labor relationship and business sustainability, helping to reactivate the national economy and job growth.
The benefit of the implementation of these emergency measures is that the right to health in general, the labor and health rights of workers in the public and private sectors will continue to be guaranteed.
Likewise, it specifies that the provision of public services to the public will continue, through the remote work modality, and the Resource Offices will be empowered to continue managing with the extraordinary measures in this matter, which were born in the pandemic context due to COVID-19 and that at present they are still very necessary since we are still in a situation of sanitary prevention.
