Parents could request teleworking after completing their licenses, according to the opinion of the Congress

The Labor and Social Security Commission chaired by the parliamentarian Edith Julón of Alianza for Progress, gave a series of modifications to the teleworking regime with the purpose of guaranteeing complementary measures to the lactation license. In total, there were 15 legislators who voted in favor and only 2 abstained.

According to the approved opinion, the mothers and fathers They would have the possibility of working remotely for 20 days after completing their maternity or paternity licenses, as the case may be. In this way, proponent legislators such as Sigrid Bazán, Carlos Zeballos, Second Quiroz, among others, seek to strengthen the family bond and infant’s health.

Congress approves changes to teleworking

In its first ordinary session of the year, the Labor Commission approved the opinion held in six legislative initiatives that modify a series of articles of Law 31572, Teleworking Law. In that sense, two paragraphs are incorporated into article six of the aforementioned norm that grant labor benefits to the new parents.

“Request Telework for twenty days immediately to the conclusion of the paternity or maternity license, in the terms established in the regulations of this law,” reads the predict.

Similarly, it is specified that both the father and the mother can work remotely in case the son or daughter of the mother infant presents anemia risk. The deadline for making use of this right concludes when the son or the infant daughter turns twelve months of age.

In addition to this, a final complementary provision that creates the prenatal death license in favor of women working in the public or private sector is incorporated. They would have the right to a ten -day license after 22 weeks of gestation and before completing childbirth.

Finally, the beneficiary workers could “make use of their vacation rest pending enjoyment, from the day after the prenatal death license.”

What factors took into account Congress to approve the opinion?

To prepare the prediction that establishes a series of complementary measures to the lactation license, the Labor Commission took into account the following:

  • The birth rate is reduced, as confirmed by INEI’s publication that indicates that the fertility rate has been reduced in a sustained way during the previous century.
  • Mothers and fathers have more than 80% of cases, between 20 and 40 years, while the use of age groups over 45 has grown by 4.6%, which indicates that there seems to be a displacement of the workforce to major age groups, which will reduce the impact of this measure on the labor market, over time.
  • The population with adequate use 1.3% and according to the publications of the Central Reserve Bank of Peru30, 6.7% of teleworkors in Peru, has a growth potential of up to 21.3% according to ECLAC.
