Reinfo: Ministry of Energy and Mines leaves without effect the suspension of more than 2,500 registrations

A few days ago, members of the National Confederation of Small Mining and Artisanal Mining (Confemin) They denounced the suspension of thousands of inscriptions in the Integral Mining Formalization Registry (Reinfo) and announced an upcoming mobilization as a form of protest. However, the measure was left without effect by the Ministry of Energy and Mines.

Through a statement, the portfolio led by Jorge Montero reported that he raised this provision that sanctioned 2,509 miners in formalization. This decision is part of the principles of informalism and presumption of veracity of the Single text ordered of the Law of the General Administrative Procedure approved by Supreme Decree No. 004-2019-JUS.

“We will proceed to send, immediately, technical teams to each of the regional directions of energy and mines, in order to verify the existence of the documents presented by the miners in formalization, guaranteeing the update of the information in the single window system,” they said.

And it is that the grounds for suspension of inscriptions in the reinfill become effective after verifying the breach of the conditions of permanence. Precisely, one of these requirements is the presentation of the environmental management instrument for the formalization of small mining and artisanal mining activities (IGAFOM), whose formats must be entered by regional addresses.

However, despite the fact that various trades were sent by the General Directorate of Mining Formalization (DGFM), these have not complied with the aforementioned provision and therefore, it was decided to suspend the inscriptions in the reinfill.

“We regret that many miners have been harmed by this situation. In order to avoid the damage that a suspension in the reinfill can cause the miners in the formalization process, we have decided to leave this measure without effect”; They said.

MINEM AND CONFEMIN: Disunvented Points

Speaking to this media, Máximo Franco Becker, president of the Confemin, accounted for a meeting with the Minister of Energy and Mines, Jorge Montero, held on the morning of Friday, February 28. As indicated, the head of the Minem promised to leave without effect the suspension of registration in the reinfined.

“They have suspended them for no reason.

But, this is not the first time that this type of meetings occur. In the fortnight of February, they dialogue about the state of small -scale mining activities and the possible solutions that contribute to their formalization. In addition, they agreed to constitute a technical table that will meet every Wednesday.

Regarding the Minem regulation project that extends the registration of miners until June 2025, Máximo Franco Becker questioned that this legal device regulates scope that does not correspond to it, which could lead to a situation of illegality.

“You cannot with a Supreme Decree to regulate what the law does not send. Law No. 32213 is only authorizing them to regulate interoperability and rectory. However, in this proposal they are raising other things not understood in this mandate of Congress. They must correct that from the Minem.”
