Indecopi fined school with more than S/45,000 for not taking actions in case of bullying in Chiclayo: this says the file

Indecopi sanctioned a school in Chiclayo for not intervening in a case of bullying. The resolution details the infractions committed and the measures that the institution must adopt to correct them.

The Commission of the Regional Office of the INDECOPI In Lambayeque sanctioned a private school of Chiclayo for not having taken measures before a case of bullying within its facilities. The educational institution was fined 8.86 Tax Tax Units (UIT)which is equivalent to S/45.629, for breaching with its obligation to protect the integrity of their students.

The case originated when a father denounced that his son was a victim of harassment and psychological violence by his classmates. Despite having informed the school authorities, they did not implement corrective actions. The lack of response motivated the INDECOPI INTERVENTIONwhich determined the responsibility of the institution in the first administrative instance.

According to the Resolution No. 0732-2024/INDECOPI-AMthe College violated article 74.1, literal f) of the Consumer Protection and Defense Code. This establishes that educational institutions must guarantee an ideal service, which includes the protection of students in situations that affect their educational process.

The denounced facts include the subtraction of a mobile phone and the DNI of the child’s mother, who were thrown to the ground and kicked. As part of the sanction, INDECOPI He ordered the educational institution to comply with the School Coexistence Protocols, which include preventive and corrective measures in cases of harassment.
