The Superintendence of Banking, Insurance and AFP (SBS) submitted to the intervention regime to the Savings and Credit Cooperative La Summit for the total loss of your Share capital and of the cooperative reserve. The measure was adopted through SBS resolution No. 00641-2025 published Thursday in the Official Gazette El Peruano.
After the evaluation of the financial information reported by the cooperative in question, the Superintendence determined a patrimonial affectation of – S/559,210.80 to September 30, 2024. However, considering a detailed adjustment in accordance with accounting assets, insolvency amounts to – s/429,272.91.
Faced with the adverse scenario, the regulatory entity appointed the auditors George Roger Vilcatoma Ollais (main) and Antonio Flores Piña (alternate), who may carry out the necessary acts to specify the inspection, in accordance with the General Law, the COOPAC Law, the Regulation of Special Regimes, and other standards.
The designated ones have the necessary power for “the determination of the real heritage of the La Cumbre Cooperativa subject to intervention.
They also have the power to perform all acts and enter into all the contracts that are necessary for the proper conduction of the cooperative How to carry out financial operations, open and close current accounts, savings or other deposits are subject to term or not; obtain certificates and perform all kinds of deposits and impositions on current accounts, savings or other deposits (term subjects or not).
In addition, they have the powers to carry out payments of the corresponding obligations, subject to the resources available; for the execution of the collections of the Cooperative’s credits.
The auditors are able to start judicial processes, arbitral and/or administrative procedures on behalf of the cooperative and continue those initiated by the aforementioned entity against third parties.
SBS: prohibitions against the cooperative
In application of the provisions of article 6 of the Special Regimes Regulation, as of the date it is prohibited:
- Start against the aforementioned cooperative Judicial or administrative processes for the collection of credits under their charge.
- Pursue the execution of judicial resolutions dictated against the cooperative.
- Constitute taxes on any of your assets in guarantee of the obligations that concern you.
- Make payments, advances or compensation or assume obligations on behalf of the cooperative, with the funds or goods that belong to it and are held by third parties.
- Constitute precautionary measure against their assets.
