Osiptel: Rafael moves immediate resolution compliance with his suspension void

The executive president of the supervisory agency for private investment in telecommunications (Osiptel), Rafael Muente Schwarz, informed that he has been prevented from resuming his functions, despite the fact that the Civil Service Court (Serve) declared void the suspension imposed by the Presidency of the Council of Ministers (PCM).

Through an X post, he announced that he presented himself at the Osiptel offices to resume his position; However, both he and Mr. Arequipeño, who have been occupying the presidency and general management, respectively, informed him that the PCM had not communicated the resolution of the SERVICE court, which declares void the sanction “that illegally imposed me” , he said.

“I demand that the resolution issued, under responsibility, is immediately fulfilled,” said Muendo.

Rafael moves: Why did they suspend it?

In September 2024, the Presidency of the Council of Ministers (PCM) arranged the suspension for a year without enjoyment of the executive president of Osiptel, Rafael Muente, under the accusation of an alleged improper use of public funds in the hiring of a training program.

However, the Civil Service Court (Serve) annulled the sanction when determining that principles of due process were violated. Mueda rejected the charges against him, arguing that the hiring of the program was carried out in accordance with the established procedures.

He also questioned the decision of the PCM, noting that he dismissed reports from both the Comptroller and the National Civil Service Authority, which ruled out the existence of an administrative fault.
