Cobra refused to give more time for the discussion of the Addendum 13 for Majes Siguas II. Through official letter N ° 304-2021, Governor Kimmerlee Gutiérrez informed the Regional Council of Arequipa (CRA) that the concessionaire did not agree to suspend until January 31, 2022 contract. With this, the final deadline is this December 30. In case you do not accept the modification of the project for US $ 104 million, the expiration period of the contract would run and Cobra will file a millionaire international arbitration against the Regional Government of Arequipa (GRA). The works would not be reactivated either.
Given the haste, the president in charge of the CRA, Ysrael Zúñiga, called an extraordinary session for today at 11.00. What drew attention is that in Official Letter No. 1965-2021 it is stated that the subject to be discussed is “The suspension of the term of addendum 13”. Is it a huge mistake that can harm Arequipa? Councilor Harberth Zúñiga indicated that his colleague should explain why he made this point. “It is not our competence to see the deadline,” he said.
The same was indicated by the counselor José Luis Hancco. And it is that the documentation that motivates the session is the Official Letter N ° 296-2021 in which it is indicated that only Cobra accepted until December 30 as a final term and an act of possible agreement. No key documentation is attached, such as the addendum itself, or the opinions of the Ministry of Economy and Finance, ProInversión or the Comptroller’s Office. “Documentation that was used for a conference has been used,” said Hancco.
For Ysrael Zúñiga, addendum 13 will be debated. He confirmed that the key documentation is not available and that he hopes that the Regional Government of Arequipa (GRA) will forward it before this morning’s session. Harberth Zúñiga said that everything has already been done before the “Los Sons del Condor” case exploded. “There was a lack of interest from the commission that I am part of and chaired by Hancco ”, noted on the absence of opinion. Hancco previously said there was no formal request from Ysrael Zúñiga for the commission to rule.
To top the virtual meeting with the Comptroller’s Office on Addendum 13 was canceled. The control body proposed that it be held on December 30.
