Indecopi recently announced the start of an administrative sanctioning procedure against a group of companies and individuals, due to indications of collusive practices in sales of pharmaceutical products to the Peruvian State.
In this regard, the Union of Trade Unions stated that it “firmly believes in the guiding principles of the free market and competition enshrined in the Constitution.”
“Free competition implies that all market players behave in full compliance with the rules governing good conduct in accordance with healthy competition; therefore, each institution has its own codes of ethics and conduct, and we do not support any anti-competitive conduct,” said the group made up of SNI, CCL, ADEX, Canatur and other institutions.
The coalition also said it believes in the need to “guarantee due process and the presumption of innocence until responsibility for the alleged crimes has been proven.”
Therefore, being at an initial stage in the investigation procedure, we must remain cautious until the process is completed, remembering that those under investigation can exercise their defense to disprove any participation in the alleged acts.
In this regard, they requested that investigations be expedited and, if the existence of collusion is proven, they specified that those responsible for causing distortions to competition with the consequent impact on the health of all Peruvians “must assume the consequences of their actions and the sanctions established by the regulatory framework.”
