110 hectares of illegally planted grapes removed: violation committed by a Peruvian producer

According to the Spanish firm, this infringement is the largest in the history of this type of case, which was achieved after several months of investigations and legal actions.

Multinational gets Peruvian producer to remove 110 hectares of illegally planted grapes

After several months of investigations and legal dispute, Bloom Fresh Internationalone of the largest hybridization companies for table grapes, cherries and plums in the world, has managed to get a Peruvian producer to withdraw 110 hectares of its Sweet Globe, Jack’s Salute, Sweet Celebration and Allison varieties, which were illegally grown on a farm in the south of the country.

“This action is a warning to all illegal producers who may be tempted or planning to illegally plant and/or produce Bloom Fresh varieties in the coming season. Bloom Fresh has a firm intention to continue acting, using all the resources at its disposal, against all those nurseries and table grape producers who illegally use its varieties and registered trademarks,” said the Spanish firm.

They also stated that “they are facing the largest illegal plantation of table grapes in the entire history of the Peruvian industry, which has caused Peruvian producers to face a heavy financial penalty.”

“Today we are sending a very clear message to the industry, informing all those producers who are thinking of planting our varieties illegally, that we will do everything in our power to destroy these illegal plantations. The violation of our intellectual property is not tolerable, and we will use all our resources against anyone who thinks they can circumvent the current legislation against the fraudulent use of intellectual property rights. This case demonstrates the significant financial consequences to which those producers who illegally produce our protected varieties are exposed,” said Josep Estiarte, CEO of Bloom Fresh.

What actions is Bloom Fresh taking to protect patents?

Bloom Fresh is one of the founding members of The Breeders Alliance, which has a network of researchers to monitor the market for possible infringements of its protected varieties. In this regard, the Spanish company has local and international legal teams to detect infringers and act against any illegal activity, thus enabling it to safeguard compliance with its patents.

They also regularly investigate and conduct DNA testing on any suspicious plants or fruits, working closely with major distributors and supermarkets worldwide to identify potential infringements of their intellectual property.

“The reason this is so important to us is simple. We take all these actions to protect our intellectual property rights over our varieties so that all those producers, regardless of the country where they are located, who have placed their trust in us to build their long-term businesses, with the aim of obtaining a better yield, can be assured that Bloom Fresh has the capacity and the intention to protect their interests. We must protect the interests of all participants in the supply chain, ensuring that those who wish to plant our varieties illegally are held accountable,” said Estiarte.

In the case of its monetary value, it reaches S/529 million 935 during the first five months of the year, while in 2023, its value reached S/738 million 804.
