The law, which was adopted by the Executive Branch in June, was unanimously approved by the Consumer Protection Committee of the Congress of the Republic.
With 13 votes in favor, the Commission for Consumer Protection and Regulatory Agencies of Public Services of the Congress of the Republic approved the opinion that recommends approving the regulation of spam calls by insistence. This opinion modifies the Consumer Protection and Defense Code, regulating the use of call centers and other means to send promotional messages without consent.
Executive observed the regulation of spam calls in June
In June of this year, Congress unanimously approved the elimination of spam calls and messages, with the aim of protecting the privacy and peace of mind of users. The law prohibited companies from making calls or sending text messages and emails to promote products and services, unless the consumer has given prior consent.
The penalties for violating this rule will be considered very serious and could reach up to 450 UIT (approximately S/2.3 million). Indecopi will be the entity in charge of applying these fines. The law would come into effect within a period of between 1 and 6 months, depending on the political agenda. Consumers will be able to revoke their consent at any time and companies must respect this decision.
However, the Peruvian Customer Experience Association (Apexo) had warned that this measure could leave 20,000 people working in call centers unemployed. They argue that the ban limits consumers’ right to information.
