“The bonus and the extraordinary bonus must be paid by Monday, July 15, 2024, provided that private sector workers have worked the entire first semester; in addition, both concepts must be registered in the electronic payroll of that month,” explained Álvaro Gálvez, manager of the Legal Center of the Lima Chamber of Commerce (CCL).
In the case of those workers who have worked only a few months and not the entire semester, that is, from January to June, the bonus will be equivalent to one sixth of the salary for each month worked. However, if the worker has unjustified absences in one month, one thirtieth of the sixth amount to be received will be deducted for each absence.
Regarding the truncated bonus, which originates at the time of the employee’s termination, payment is made provided that the employee has at least one full month of service. In this regard, The amount of the truncated bonus is determined proportionally to the complete calendar months worked from January 2024 until the date of termination.
On the other hand, in the case of commission agents and pieceworkers, the amount of remuneration for the payment of their bonus is obtained based on the average commissions received in the six months prior to July 15, 2024.
The CCL Legal Center explained that the payment of the bonus does not consider profits, extraordinary bonuses, mobility allowances, education, travel expenses and other non-remunerative concepts, provided for in Art. 19 of the CTS Law.
If I have EsSalud, how much bonus am I entitled to?
If you worked for 6 months from January 1 to June 31, the bonus will be the gross salary plus an additional 9% of the salary for EsSalud.
Example: Pablo is a worker with EsSalud insurance, he has been working since January, his salary is S/2,000 Soles. The account would be S/2,000 x 6 / 6 = 2,500 + 9% = 2,180
That is, Pablo would receive S/2,180 on July 15.
If you did not work the 6 months from January 1 to June 31, the calculation is proportional to the full months you have worked.
Example: André is a worker with EsSalud insurance, he has been working since March 12, his salary is S/2,000. The amount of his bonus would be: 2,000 x 3 / 6 = 2,500 + 9% = 1,090
That is, André would receive S/1,090 on July 15.
