Companies have until July 15 to deposit the bonus, in the context of the National Holidays. A company that does not comply with this labor benefit would incur serious misconduct, according to Jimmy Huatuco, project manager at Buk Perú.
How much bonus will I receive?
The employee who has been there for a full semester—in this case, from January to June—will receive an equivalent to a monthly remuneration exempt from taxes and discounts, added to an extraordinary bonus corresponding to the 9% that the employer usually contributes to EsSalud (6, 5% in the case of those who have EPS).
The formula is the following: gross monthly salary plus family allowance (for those who have minor or dependent children) plus 9% of the calculation of the legal bonus (6.75% in the case of those who have EPS).
For overtime, bonuses or commissions to be included in the bonus, they must have been received at least three times in the semester and be linked to the monthly salary.
How much is the fine for withholding the gratuity?
If an employer does not deposit the bonus within the legal period, the fines range between 0.45 UIT (S/ 2,317.5) and 4.5 UIT (S/23,175) for small companies and up to 21.12 UIT for non-mypes (S /134,518).
Huatuco adds that, in the event of termination or if a worker resigns before July, they must receive a truncated bonus calculated in proportion to the time worked in that semester.
