Osiptel confirms a fine of more than S/282,000 against Telefónica

The Supervisory Body for Private Investment in Telecommunications (Osiptel) confirmed a fine for a value of 54.9 UIT (S/282,735) against the company Telefónica del Perú, for poor line activations and for lack of verification in contracting, after Telefónica’s appeal be declared unfounded.

The resolution of the General Management No. 95-2024-GG/OSIPTEL, published on March 20, establishes that, between April 1 to November 30, 2021, the contracting of a total of 32 mobile public service lines It was carried out without the subscribers having gone to an office or customer service center.

Likewise, it was verified that In 28 contracted public mobile service lines, verification was not carried out that the IMEI, that is, the code pre-recorded on mobile phones, is valid.

Based on said analysis, the First Instance determined the imposition of a fine for failing to comply with the Seventh Transitional Complementary Provision of the Complementary Standards of the National Registry of Mobile Terminal Equipment for Security (Renteseg).

“Therefore, the imposition of the administrative fine was framed in the current provisions and the actions of Osiptel occurred in the legitimate exercise of its powers and in compliance with the Principle of Reasonableness,” the document details.

Claro must also pay Osiptel 34.7 UIT (S/170,775 in 2023)

Through Resolution No. 007-2024-TRASU/PAS/OSIPTEL, it was resolved that the operating company Claro did not comply with making notifications under the door in eight complaint procedures associated with complaint files from different users, thus disobeying the article 38 of the Claims Regulations. Along these lines, the payment of S/170,775 of the fine was requested.

Faced with this, the company filed an appeal against the contested resolution, maintaining that the principles of material truth and legality, as well as the principle of legality, had been violated.

Thus, this Board of Directors, after analyzing the screenshots contained in the appeal, warned that they are not useful to exonerate the operating company from liability. Therefore, the appeal filed was declared unfounded, exhausting the administrative route, reaffirming Osiptel’s fine.
