Indecopi ratifies antidumping duties applied to closures imported from China, Malaysia and Taiwan

The case began to be heard in 2022, when Corporación Rey SA requested Indecopi to initiate an examination procedure for alleged practices of circumvention of definitive anti-dumping duties on imports of closures.

The Court for the Defense of Competition and Intellectual Property of the Specialized Chamber for the Defense of Competition of the National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi) confirmed the extension of the definitive antidumping duties imposed on imports of zipper closures and their parts originating in the People’s Republic of China, to imports of zipper closures and their parts from Malaysia and Taiwan, whether or not declared as originating in Malaysia and Taiwan.

Resolution No. 0082-2024/SDC-INDECOPI published today in El Peruano ratifies Resolution 056-2023/CDB-INDECOPI of June 27, 2023, through which the Commission on Dumping, Subsidies and Elimination of Trade Barriers No Indecopi’s Tariff Office determined to extend the definitive antidumping duties -imposed by Resolution 293-2021/CDB-INDECOPI-on these closures.

“The basis is that, during the period of analysis of this case, compliance with the legal and economic conditions that support the existence of an avoidance practice has been verified in accordance with the provisions of Law 31089, Law that confronts the practices of Antidumping and Countervailing Duties,” the document states.

The case began to be heard in 2022, when Corporación Rey SA requested Indecopi to initiate an examination procedure for alleged practices of evasion of definitive anti-dumping duties on imports of zipper closures and their parts originating in the People’s Republic of China, according to to the provisions of Law 31089, Law that confronts the practices of Avoidance of Antidumping and Countervailing Duties (hereinafter Anti-Avoidance Law).

It was determined that after tariff barriers were applied against imports of closures from China, importers began to bridge their shipments from other Asian countries, such as Taiwan and Malaysia.
