Debts in coercive collection exceed S/3,400 million

The National Superintendency of Customs and Tax Administration (Sunat) reported that there are 1,147 companies that maintain debts in coercive collection greater than 10 ITU (S/51,500 soles).

The collecting entity detailed that the total sum of the amount owed for all these taxpayers exceeds S/3,400 million.

It is important to highlight that the firms included in the publication are in coercive collection processes; That is, the tax administration exhausted all possible avenues to demand payment of the corresponding debts and they have not honored them.

In this sense, in order to promote voluntary payment with the modalities and services offered in order to increase the levels of recovery of what is owed, Sunat also published the business name of each debtor, as well as their legal representatives.

The most indebted

From this, it was highlighted that it is the agro-industrial companies that carry the greatest debts.

In detail: Agropucala SAA, with a debt of S/502 million 469,536; Pomalca SAA, with S/408 million 232,862; the sugar agricultural company Andahuasi, SAA with S/195 million 920,577, among others.

The publication of the required debt – already suitable for collection – and of the legal representatives will be carried out periodically in accordance with the provisions of numeral 1 of the fourth paragraph of article 85 of the Tributary Codeconsidering that this information is not protected by the tax reserve.

Thus, the list of the main taxpayers with the highest tax debt due can be reviewed on the Sunat web portal.

This information is being published through individual consultation and risk centers.

On the other hand, The supervisory body has the power to attribute joint and several liability to the legal representatives. for the debts of the companies they represent.

Debt of large companies

The tax debt held by large companies in Peru amounts to S/28,325 million, reported the head of Sunat, Gerardo López.

86.9% (S/24,621 million) cannot be collected, as it is disputed. Meanwhile, 12.6% of the total debt is within the deadline to be challenged; 0.1%, in the bankruptcy stage; and 0.4%, as enforceable debt.

Only 0.1% of debts already contested had their origin in a statement by the taxpayers. 99.9% were detected through inspection work.

Tax collection in the fourth month of the year amounted to S/17,620 million, 4% more than in April 2023.
