Taxi by application: companies will be responsible for the crimes of their drivers

By majority, the Plenary Session of Congress approved an opinion that regulates the taxi service by application, whether Peruvian or foreign companies. Thus, firms such as InDrive, DiDi, Uber, Cabify and Yango must adapt to the regulations that will be prepared by the Ministry of Transportation and Communications (MTC) within a period of no more than 90 calendar days from the publication of the law.

The text creates the National Registry of Intermediation Management Companies of the Private Special Transportation Service through Technological Platforms. The mentioned companies are required to detail the list of their drivers and will have to update it every three months.

Likewise, they consider that taxi applications will assume responsibility, within an administrative or judicial process, for the criminal conduct of their drivers.

Eduardo Salhuana, president of the Congressional Transportation Commission, noted that These apps circulated taking advantage of a legal loophole and not assuming responsibility for thefts and complaints.

Apart from the essential information that they will provide to the public – such as the identification of the vehicle and driver, fare, service qualification, terms and conditions, route and alert mechanism in case of emergency that endangers the passenger – they must also present to the MTC the driver’s DNI, his criminal record certificate, driver’s record, proof of technical inspection of the vehicle and its respective identification, as well as the SOAT, among other criteria determined by the regulator.

In the event that InDrive, DiDi, Uber or another firm fails to comply with security requirements, the MTC will ask internet service providers to block access to taxi applications and websites so that they do not operate.
