Employment contracts must be signed before starting work in a company, according to the National Superintendence of Labor Supervision (Sunafil).

This is due to the fact that some employers ignored the right of their employees and only proceeded to sign it once the trial period had passed or by setting different dates.

“The employer should not require its workers to sign out-of-date contracts, since if a contract is not signed at the beginning of the employment relationship, the nature of the contract will be indeterminate,” indicated Fabiola Rueda, deputy director of prevention and advice at Sunafil.

Likewise, he emphasized that employers must give a copy of the contract to their workers within three business days and these contracts can be presented as evidence in case the worker files a subsequent complaint with Sunafil.

And, in the case of a work certificate, this must be issued within 48 hours after the employment relationship was completed.
