CCL: taxation of mypes should be based on their profits and not only on income

The Lima Chamber of Commerce (CCL) presented its analysis and comments on Bill 7752/2023-PE, which delegates to the Executive Branch the power to legislate on economic regulation, regulatory simplification and quality, state business activity, security citizenship and national defense.

During the meeting with the president of the Council of Ministers, Gustavo Adrianzén, the union delivered proposals that it considers “relevant in the areas of economic reactivation, tax system, State contracting, health and arbitration.”

In terms of economic reactivation, the CCL proposes maintaining prudent fiscal management, promoting reforms that improve the results and execution of public investment, financial support, training for micro, small and medium-sized enterprises (MSMEs) and the creation of private free zones.

Likewise, it suggests promoting public and private investment projects, especially in the mining sector, and the execution of projects with a larger budget at the national and regional level.

In tax matters, it proposes continuing with the simplification of bureaucratic procedures and promoting the digitalization of processes; A special fractionation regime is established for the payment of tax debt and the taxation of small businesses is established on the basis of profits and not only on income.

In addition, it suggests support for various legislative initiatives that encourage the export of services in strategic sectors such as the manufacturing and maquila export regime.

CCL: strengthen dialogue between employers and workers

In citizen security, it proposes the creation of a Secretariat or Undersecretary of Citizen Security in the Vice Ministry of Territorial Governance of the PCM.

“We propose targeted interventions against illegal and illicit economies, the creation of an Information Unit on extortion in the customs, construction and commercial sectors, where the systematic classification of information from extortion is compiled. All of these actions seek to reduce the high rates of crime and extortion,” said Jaime García, director of the CCL.

In labor matters, the business union proposes strengthening the spaces for broad debate on the labor regulatory agenda, which considers the active participation of workers and employers, such as the National Council of Labor and Employment Promotion (CNTPE).

“This measure will make it possible to achieve concerted solutions in this matter, providing it with social legitimacy, mainly in topics of general interest such as labor outsourcing, collective labor relations, minimum vital remuneration, the draft of the new Labor Procedural Code, management and new governance of EsSalud, among others,” said García Díaz.

CCL: changes to the General Public Procurement Law

Regarding the General Law of Public Procurement, it proposes to reevaluate articles 74 and 86 of the original law that modifies the current regulations, which is why it suggests eliminating the requirement of counter-caution in all cases, without exception, and that it be guaranteed that All appeals are resolved by the State Contracting Court.

In the Health sector, the CCL proposes strict compliance with the Public Procurement Law and the recognition of partial payment of contractual commitments in situations that warrant it.

In relation to arbitration, the CCL joins the concern over the proliferation of arbitration centers created without greater rigor and that in some cases engage in improper practices. It proposes establishing specific rules for arbitrations in which the Peruvian State participates, and which could contain a section related to the creation of the aforementioned centers.

Finally, it requests the effective reactivation of the technical tables of the Ministry of Economy and Finance (MEF), as it is a valuable space that has been essential for the resolution of operational and vital problems in various sectors.
