Sunat: large companies owe the State more than S/28,000 million

The tax debt held by large companies in Peru amounts to S/28,325 million as of April 30 of this year, reported the head of the National Superintendency of Customs and Tax Administration (Sunat), Gerardo López.

During his presentation before the Congressional Oversight and Comptroller Commission, The superintendent revealed that, of this total, 86.9% (S/24,621 million) cannot be collected, as it is contested. “Meanwhile, 12.6% of the total debt is in the deadline to be challenged; 0.1%, in the bankruptcy stage; and 0.4%, in the debt stage payable by Sunat,” said López.

Likewise, it reported that only 0.1% of the debts already contested had their origin in a declaration from the taxpayers themselves; that is, they appeared before the Sunat. The other 99.9% was detected through inspection work.

It is important to highlight that tax collection in the fourth month of the year amounted to S/17,620 million, 4% more than in April 2023, but which rounds out an accumulated drop since January of -6.3% compared to the first quarter of the year. last year.

What is the status of the disputed debts?

Of those contested S/24,621 million, 11% (S/2,638 million) is in the Claim stage before Sunat; 77% (S/18,899 million), in the Appeal stage before the Tax Court; and the other 12% (S/3,084 million) in Demand before the Judiciary.

Sunat plans to resolve the claims corresponding to 11% of the contested debts in no more than six months. On the other hand, the Tax Court has a period of between 12 to 18 months to resolve the 77% that are in the appeal stage.

Meanwhile, although the Judiciary does not have a specific deadline to resolve the S/3,084 million that are being prosecuted, the average to do so could be around three years.

How much is Las Bambas’ debt?

The mining debt The Bambas It amounts, until April 30, to approximately S/9,000 million. However, it is currently in litigation. In that sense, since it is contested, Sunat cannot recover it until it is resolved.

On the other hand, the superintendent emphasized that in April tax revenues grew by 4%, this being a positive trend that encourages the projections for the following months.
