On April 19, the Tenth Specialized Administrative Litigation Court of the Superior Court of Justice of Lima presented its first resolution regarding file 00017-2024-0-1801-JR-CA-10, in which the exclusivity of services of the Port of Chancay, run by the company Cosco Shipping.
The resolution, leaked in various media, points out flaws in the lawsuit presented by the National Port Authority (APN) through the Attorney General’s Office of the Ministry of Transportation and Communications (MTC).
The court determined errors in the drafting of the complaint, such as inaccuracies with the dates of the notification to the parties and details about the address of the defendant company.
From that moment, APN had five days to correct the observations. Otherwise, the case would be declared inadmissible by the Judiciary.
So far, neither party has confirmed the filing of the case.. Cosco Shipping also presented a request for annulment on the 23rd, this time as plaintiff, based on the observations raised days ago.
“We have never been notified of this lawsuit, since the court has to do it after it admits it. Since it has not been admitted, we have not been notified, the Attorney General’s Office never sent us a copy,” a source close to Cosco Shipping told The Republic.
