The Supervisory Body for Private Investment in Telecommunications (Osiptel) ratified a new fine of S/2 million 127,510 (429.8 UIT of 2023) against the company Telefónica del Perú for delays in the execution of requests to cancel its service.
In February 2023, the Directorate of Inspection and Instruction (DFI) of Osiptel notified Telefónica of the initiation of an administrative sanctioning procedure (PAS) for having failed to execute cancellation requests within 5 business days, in the period between on October 1, 2021 and March 31, 2022, for a total of 19,145 mobile lines.

Osiptel determined that the Spanish capital company did not execute the cancellation requests within a maximum period of 1 business day, after their presentation, in the period from October 1, 2021 to March 31, 2022, for a total of 41,605 cases.
Furthermore, it did not deliver the required information within the established period, on a mandatory basis and within the peremptory period, by letter No. 887-DFI/2022. The three aforementioned offenses are classified as serious by the regulatory body.
The fine imposed, through Resolution No. 384-2023-GG/OSIPTEL on November 13, 2023, amounted to 429.8 UIT for the three cases. In January 2024, Osiptel rejected Telefónica’s appeal for reconsideration, so the company decided to appeal in February.
Finally, the resolution of the Board of Directors No. 00110-2024-CD/OSIPTEL, published this Friday, April 19, ratified the fine of S/2 million 127,510 against Telefónica, thus exhausting the administrative route and not allowing any additional appeal. The company could still prosecute the debt.
