They modify the Contracting Law to optimize the execution of works with a partial file

The Peruvian Government modified the Regulation of Law No. 30225, State Procurement Law, approved by Supreme Decree No. 344-2018-EF, in order to optimize the processes of execution of works in the country.

Among other aspects, supreme decree No. 051-2024-EF establishes that, from now on, the central government and regional governments will only be able to execute partial approvals of their technical work files, by sections, stages, components or sectors, when they have achieved a percentage of financial execution of investments greater than or equal to 70% in the two fiscal years prior to the call for the respective selection procedure.

Furthermore, in work contracts that include design and construction, the parties will incorporate in the dispute resolution clause of the contract “that their solutions are in charge of a Dispute Resolution Board.”

The decree establishes that, in these contracts, the Dispute Resolution Board will begin to exercise its functions during the contractual execution, which begins with the preparation of the Technical File.

The State Procurement Law establishes rules aimed at maximizing the value of public resources that are invested and promoting action under the results-based management approach in the contracting of goods, services and works.

The objective is that the works are carried out in a timely manner and under the best price and quality conditions, allow the fulfillment of public purposes and have a positive impact on the living conditions of citizens.
