The Ministry of Agrarian Development and Irrigation (Midagri) approved today the regulations of the National Registry of Agrarian Cooperatives, through a supreme decree published in the official newspaper El Peruano.
Thus, Midagri is empowered to issue the complementary rules that are necessary for the better application of the aforementioned regulations. And, the administrative procedure is incorporated into the Single Text of Administrative Procedures (TUPA).
The regulation is in line with article 26 of the recently enacted Law for the Improvement of the Associativity of Agricultural Producers in Agricultural Cooperatives, to regulate and put into operation this national registry.
The General Directorate of Associativity, Financial Services and Insurance, Midagri’s line organ, is in charge of registering, denying, updating, canceling or sanctioning cooperatives and agricultural cooperative centers in the aforementioned registry.
Registration in the National Registry of Agricultural Cooperatives is free, whose information can be consulted by citizens, through the digital media that Midagri enables for this purpose.
The documentation presented by the legal representative of the cooperatives has the character of an affidavit for all legal purposes, so it is responsible for the veracity of its content.
The presentation of fraudulent or false, inaccurate or outdated information for the registration entails the nullity of the administrative act that approved it, without prejudice to the administrative, civil and criminal responsibilities that arise from this situation.
The standard provides for the publication of the regulation on the Single Digital Platform for Citizen Orientation and on the Midagri website.
