DirecTV: Osiptel ratifies a fine of S/1.7 million for not improving user service channels

Among the causes are “preventing or denying the presentation of claims, resources and complaints”, and “not providing the user, at the time of submitting the claim, information about their right to access the file and the maximum period of the company operator to resolve the claim.”

The Supervisory Body for Private Investment in Telecommunications (Osiptel) ratified a fine of 350 UIT (S/1 million 732,500 in 2023) against the company DirecTV Perú for not having complied, as urged, to improve its user service channels.

Previously, Osiptel had applied corrective measures against DirecTV Perú in 2021, after “preventing or denying the presentation of claims, resources and complaints”, and “not providing the user, at the time of submitting the claim, information about their right access to the file and the maximum period of the operating company to resolve the claim”.

In October 2022, the Peruvian regulatory body resolved that the company had not “implemented the necessary measures and/or actions to guarantee that the aforementioned sanctions are not incurred again”, so, in July 2023, it was imposed a fine of 350 UIT. The company appealed just a month later.

The resolution of the board of directors No. 00082-2024-CD/OSIPTEL, published this Friday, March 29, 2024, ratifies the sanction against DirecTV Perú and, in this way, exhausts the administrative route, “there is no appeal in this way” ( it could still be prosecuted).
