The judge considers that the Gipuzkoa Provincial Council did not commit any crime when collecting tolls from trucks

The Court of Instruction number 1 of San Sebastián thus dismisses the complaint of the Gipuzkoan transporters against the Provincial Council and the deputy Aintzane Oiarbide for the collection of truck tolls on the NI and the A-15.

The Examining Court number 1 of San Sebastián has notified this Tuesday the dismissal of the case in relation to the complaint filed in June by the general secretary of Hiru Euskal Herriko Garraiolarien Sindikatua, against the Provincial Deputy for Infrastructure of Gipuzkoa, Aintzane Oiarbide, and against the public company Bidegi, which manages the collection of truck tolls on the NI and the A-15.

Hiru filed the complaint against both for “disobeying” the ruling of the TSJPV and the Supreme Court that declared “illegal” the collection of these tolls.

Both Hiru and the National Federation of Transport Associations of Spain (Fenadismer) considered that “far from executing the judicial ruling”, the provincial institution of Gipuzkoa “kept the collection of tolls without legal coverage”.

Faced with these arguments, the instructor considers that there is no crime because at the time of the presentation of the complaint and the complaint the sentence that annulled the provincial order was not firm.

According to the order, there is no record that after October 21, 2021 the payment of the fee had continued and that prior to that date there was a rule that protected the collection of said fee.

Consequently, the judge considers that there are no indications of criminal offenses, without prejudice to the possible claims that could be made.
