Most of the modifications in the workplace – public and private – that came into effect in 2024 have been promoted by the Congress of the Republic. Between new holidays and licenses, both workers and employers must be aware of the changes to obtain the benefits and, also, to avoid incurring non-compliance and fines.
Leave for the death of a loved one
In December of last year, the Regulations of Law 31602 were published to specify the scope of the law that establishes leave for the death of family members of private sector workers. This benefit is for five calendar days for the death of spouses, parents, children and siblings. In addition, the period could be extended if the worker has to move from his or her place of origin. Once the license has ended, the worker must prove the link with the deceased person.
For the Echecopar Study, a shortcoming of the rule is that it does not specify when the license must begin, which is why they recommend that it be granted within a short period of time close to death.
This 2024 has four more national holidays
Peru has become the country with the most paid days off compared to OECD and Pacific Alliance countries. In total there are 16 national holidays in which workers in the private and public sectors have the right to paid rest.
However, the Lima Chamber of Commerce (CCL) specifies that private sector workers who work on those holidays may receive triple payment for each of those days, if they perform in-person or remote work and without substitute rest. It is not considered a day worked on a holiday when the work shift begins on a business day. The four holidays added in the last three years are July 23, Peruvian Air Force Day; June 7, Battle of Arica and Flag Day; August 6, Battle of Junín; and December 9, battle of Ayacucho.
Inventives for hiring young people
Law 31828, the Young Entrepreneur Law, was enacted in July and came into effect this year; However, it has not yet been regulated, the deadline ended in September.
The standard provides advantages to companies that hire personnel between 18 and 19 years of age. Labor lawyer Kelly Sarmiento details that companies will be able to make an additional deduction of 50% in the basic remuneration for the calculation of income tax, they will also be able to request a refund of VAT on export operations, and companies formed by young people who participate In public tenders they will have an additional score bonus of 5% in the technical proposal.
The young people hired must not have been on the payroll in the previous 12 months and the remuneration will be up to S/1,700 with a minimum contract of one month.
Single Labor Certificate is now available
The Ministry of Labor and Employment Promotion (MTPE) published the regulations of Law 31760, Law of the Single Labor Certificate (CUL), to facilitate access to the labor market for people over 18 years of age. Access is completely free and virtual.
Labor activist Jorge Toyama explains that the CUL will allow employers to access information about applicants regarding their judicial and criminal records, in addition to their previous work experience, and even the place where they studied.
This document replaces the Single Labor Certificate for young people (Certijoven) and Single Labor Certificate for adults (Certiadulto). In addition to being of legal age, other requirements to apply for it are to have a DNI (or immigration card) and have an account in the National Employment Service of the MTPE.
They seek to extend paternity leave
In January, the Congressional Labor and Social Security Commission approved a replacement text for the predictamen to extend paternity leave from 10 to 15 days for public and private sector workers; and in the case of natural birth or cesarean section.
Likewise, it will be extended to 25 days when the birth is premature or multiple. It should be remembered that since 2009 this permit was for 4 days, and in 2018 the last current modification was made.
