What to do if my flight is delayed?

According to Indecopi, when a flight suffers delays attributable to the airline, it must inform you of the causes and the measures it will take to resolve the problem. Depending on the waiting time, you are entitled to different compensations:

  • More than 2 hours and less than 4: a snack and the possibility of making a phone call.
  • More than 4 hours and less than 6: In addition to the snack and the call, you must be provided with food appropriate to the time of day (breakfast, lunch or dinner).
  • More than 6 hours: You are entitled to all of the above, plus accommodation and transportation if you need to spend the night, as well as a minimum compensation equivalent to 25% of the value of the unfulfilled journey.

What to do if my flight is suspended?

If your flight is canceled, the airline has the obligation to offer you a substitute flight on the same day or refund the net value of the ticket. If this measure is not met, lodging, food and transportation expenses must be covered. In cases of overbooking of tickets, the company must ensure your trip on the next available flight or facilitate arrangements for another boarding. If an agreement is not reached, you are entitled to the compensation already mentioned.

In situations where the airline refuses to offer adequate compensation or fails to comply with its obligations, it may face an administrative sanctioning process, with fines that can reach up to 450 UIT, equivalent to more than 2 million soles. It is important to remember that between January 2022 and May of that year, Indecopi imposed 712 sanctions and 1,079 UIT in fines on various airlines.
