Industrialists insist that the sale of Enel to Chinese capital will create a monopoly

Following Indecopi’s approval of the sale of Enel Distribución Perú SAA and Enel leads to “a 100% concentration” in the Lima electricity market, since distribution will be carried out by Chinese state companies, considering that since 2020 China Three Gorges has owned Luz del Sur.

Thus, the SNI urged Indecopi to publish as soon as possible the authoritative resolution of the Enel acquisition operation, and hopes that this body “has considered all the implications, risks and potential restrictions on free competition” after the sale.

He also urged the competent authorities to exercise “strict surveillance” of the conditions set in the sale of Enel and the behavior of the Chinese companies that will ensure the electricity supply, in order to avoid harm to capital users.

Electrical distribution: a natural monopoly

Rafael Laca, Enerkory specialist, remembers that the electrical distribution fosters a monopoly per se, and where rates are regulated by Osinergmin—with the exception of free customers who consume more than 200 kW— and here, the distribution companies, “due to their desire for profit”, generally charge close to the maximum threshold.

The professional points out that the arrival of Chinese companies to the electricity distribution market will not translate into an increase in the rates paid by households, because these are subscribed for a certain time, and are adjusted quarterly by Osinergmin.
