The Superintendency of Banking, Insurance and AFP (SBS) has approved complementary rules and the operating procedure so that public entities can benefit from the Regime for Rescheduling Payment of Pension Contributions to the Pension Funds of the Private System for the Administration of Pension Funds owed by public entities (Repro AFP III).
SBS Resolution 00197-2024 seeks for the aforementioned entities to regularize their debts for pension contributions accrued until December 31, 2022, for the benefit of members of the Private Pension System (SPP).
According to the rule published today, in compliance with Supreme Decree 272-2023-EF, public entities of the national government, regional governments and local governments can benefit from the Repro AFP III until February 28, 2024 and carry out the fractionation of the debt up to 120 installments.
“For this purpose, through the AFPnet portal, entities will be able to consult and determine pension debt information, and benefit from this regime,” the SBS said in a statement.
By benefiting from this regime, the debt will be updated based on the average profitability of fund 2 of the SPP, replacing the interest and fines regularly applied, thus promoting the recovery of contributions not paid on time and their corresponding crediting in the accounts. of the affiliates. In this regard, it should be noted that the start of the payment schedule will be in January 2025.
On the other hand, an order of priority for contributions has been established, based on the pension status of each worker as of December 31, 2024.
In this way, priority is given to contributions that make pension insurance coverage and the receipt of pension benefits viable. With this precision, insurance coverage can be reactivated for those cases postponed due to lack of contributions.
The AFPs, through their various channels, must provide information and advice related to the Repro AFP III, informing on the use of the AFPnet portal for the purposes of this reprogramming.
This process includes providing information on the pension debt, the acceptance period for the rescheduling of payments provided in the regulations, the process of determining pension debt, among other aspects.
