Congress approves extending the retirement age limit

The Permanent Commission of the Congress of Peru has approved, in the first vote, to extend the retirement age of workers to 75 years. This measure, according to Congressman Pasión Dávila, who supported this ruling, It is intended to adapt to the changing needs of the country’s workforce and demographics, as they demonstrate that life expectancy has increased.

What does this proposal consist of?

The approved opinion allows employees to request voluntarily extending their working life up to 75 years of age. This proposal includes a mandatory medical evaluation to ensure that only those in optimal physical and mental condition can benefit from this option.

This initiative focuses on providing greater flexibility to workers, rather than imposing a fixed retirement age. The law’s facultative approach aligns with the global trends, where the experience and contribution of older workers in the labor market is valued.

In the opinion, it is noted that human resources offices have to consider medical evaluation. “If the employer rejects the worker’s request without evaluating this report or the result of the medical evaluation, the rejection is presumed to be a null dismissal.”reads the approved opinion.

When will the second vote be?

After its initial approval in the Permanent Commission, a second vote is pending. This stage is crucial for the final implementation of the law. According to article 78 of the Regulations of the Congress of the Republic, this will happen after seven calendar days, that is, next Thursday, January 25.
