The director of PRO Democracia, Luciano Lopez, assured that a new agreement for the Amazon is necessary that is based on the “urgent need” to approve a new legal order for the region, based on amending what is systematically breached with Law No. 27037 (Development Law of the Amazon).
During his participation in the second day of the III Amazon Business Congress: “The urgent challenge of sustainable and inclusive development of the Peruvian Amazon”, the constitutionalist said that this debate should also address the problems associated with each wrongdoing that affect eastern Peru in a context as delicate as climate change.
“The development of a sustainable Amazon cannot focus only on tax exemptions. The economic scheme must go hand in hand with the serious promotion of private investment with full respect for the environment and, above all, for the law, as well as an agile public investment dynamic ”, he demanded.
In this sense, López specified that there are about 10 million deforested areas, of which approximately one third is used for agricultural purposes. Based on this, he established that the law should provide for the improvement of productivity in already deforested areas to avoid continuing to expand the agricultural frontier.
At this point, he took as a reference the proposal of the NGO Law, Environment and Natural Resources (DAR) to outline that the management of these areas should contain a strong legal component.
“This law must provide that land rights are assigned, since, to the extent that there is no legal certainty, illegal activities will probably increase with an impact on forests and populations. A moratorium must be established in the law to complete community titling processes, as well as the assignment of other rights according to the Amazonian reality, “said the head of PRO Democracia.
Likewise, he stressed that the law should promote that, in assigning land rights, priority be given to private reforestation activities on cleared territories. For this, he pointed out the need for a land census of this nature for public or private activity in order to promote this activity in a dynamic and aggressive manner.
“The process of change of use is thinking, according to the Forestry Law, for agricultural activities. Currently it is a terrible thing that reforestation companies are asked to change the use of land, when that was intended for agricultural purposes ”, said the lawyer.
