Independents with less than S/3,755 in income do not pay IR

Independent workers—fourth category income—who issue receipts for fees and have income less than S/3,755 per month will not pay income tax, in accordance with Superintendency Resolution 000270-2023 of the Sunat. This is in line with the increase in the value of the Tax Tax Unit (UIT) for 2024, which is now S/5,150. Previously, the monthly amount to be exempt from taxes was S/3,609.

In addition, those who project that their income during the current year from fourth and fifth category income does not exceed S/45,063 may request the suspension of withholdings and their payments on account of income tax.

Although this is a smaller group of taxpayers, according to accountant Miguel Torres, the measure also applies to professionals who have functions as company directors, agents, executors or similar and receive income for these functions and in addition to other fourth-rate ones. or fifth categories, and that the total amount received in the month does not exceed S/3,004. Likewise, they may request suspension when income does not exceed S/36,050 per year.

In this way, the Sunat remembers that if during 2024 the indicated amounts are exceeded, as the case may be, the taxpayer must declare and make the payment on account of the income tax, for the entirety of the fourth category income obtained. .

When making the suspension request, Torres remembers that for taxpayers who are already operating under this regime, they must always enter the year since they began issuing receipts for fees. Thus, the Sunat system will ask you to enter the gross income received in the last year to evaluate whether or not the order is authorized. Only users who issue fourth-rate receipts for the first time will place the income projection.

“The issue of savings is very complicated for people, but for me generating an ‘unauthorized’ fourth category suspension is like a kind of savings,” he comments.

The expert details that applying withholding on all receipts issued in 2024 will generate savings in March 2025, when making the sworn declaration as a natural person, and if the limit is not exceeded, you will be able to request a refund and earn interest.
