On December 19, President Dina Boluarte presented an assessment of her first year in government together with her ministers. In her speech, she highlighted as an achievement that S / 164 million was allocated to the Fonavistas as a reflection of the commitment that the Executive has to do justice and return the money to the workers who for many years contributed to the National Housing Fund ( Fonavi).
“This Thursday the 21st the return will begin with a first stage in favor of 64,000 people, for which we have allocated S/164 million. In this way, we address the legitimate claim of those who, with their work and effort, contributed for years to Fonavi, with the promise of accessing housing, but who were unable to do so because various governments allocated those resources to other purposes. I must specify that this is a process in which the State continues to be committed,” were the precise words of President Boluarte.
But the response from the Fonavistas union and the president of the Ad Hoc Commission, Luis Luzuriaga, did not wait long. He said that this statement is “totally false”, since the Executive Branch has not allocated a single sol to return the Fonavistas and, furthermore, in practice it has been the main opponent for this to happen.
“The money that has been arranged (for the refund) is not only the S/160 million, it is the S/2,300 million that have been accumulating in the Commission’s accounts as a result of the payment of third-party debts. That money is which has been arranged to be advanced as payment on account through Law 21928. And S/160 million has been allocated from there, but this is money from the Commission, it does not come from the public treasury or the Central Government“Luzuriaga detailed.
How has the Executive Branch opposed the initiation of the return?
The then Minister of Economy Kurt Burneo indicated that we should wait for the Constitutional Court (TC) to resolve the unconstitutionality lawsuit raised by the Executive Branch against the Congress of the Republic in relation to the Law 31173. This decision was announced in March 2023. In this way, the total amount of the refund was reduced by 90%: it went from S/42,000 million to S/6,000 million.
When the Ad Hoc Commission wanted to approve the regulations for the returns, the members representing the Executive in this working group indicated that it could not be done because the law did not allow the delivery of partial certificates of recognition of contributions and rights (Cerad). . For this reason, in June, Congress approved a bill to allow payments on account of the total debt, but this was observed by the Executive.
The document returned to the Legislature and a new text was worked on that was again approved unanimously. The Executive, instead of publishing it in the following days, chose to publish the rule almost to the limit – on November 11 -, increasingly lengthening the deadlines and, therefore, the restart of payments.
It should be remembered that in the 2023 public budget an item of S/50 million was approved for payment to Fonavistas; However, this money has not yet been transferred to the Ad Hoc Commission. Furthermore, for the 2024 budget – which amounts to S/240,806 million -, prepared during Boluarte’s management, and which has been recently approved, nothing has been allocated for the return of contributions.
