Fonafe: MEF establishes austerity measures for companies under state control

The Ministry of Economy and Finance (MEF) approved new provisions on austerity, discipline and quality in public spending, as well as personnel income, applicable to Fonafe, the companies under its scope and EsSalud as applicable.

From now on, the celebration of new employment contracts with natural persons must have technical and legal support – in addition to the corresponding budget availability -, and is only carried out to cover budgeted and vacant Personnel Allocation Table positions, as well as to their substitutes, and to cover temporary needs in accordance with the Labor Productivity and Competitiveness Law.

The Boards of Directors of the companies under the scope of the holding, the Executive Directorate in the case of Fonafe, and the Board of Directors of EsSalud are empowered to approve these hires.

This power may be delegated to the General Manager or equivalent position in the case of companies under the scope of Fonafe and EsSalud, and to the Corporate Manager of Shared Services or equivalent position, in the case of the state Congolese; “except in the case of hiring managerial personnel or equivalent positions.”

Fonafe: changes in collective bargaining

On the other hand, the collective negotiations of the companies under the scope of Fonafe are carried out on the basis of their approved budget, and must respect the principles of forecasting, programming and budget balance, as well as their financial sustainability.

In collective negotiations, the position of the Companies and EsSalud must be established in accordance with the fulfillment of indicators that mean improvements in performance.

The arbitrators appointed by companies under the scope of FONAFE and by EsSalud to participate in labor arbitrations must be chosen taking into account their previous performance in similar arbitrations in defense of the interests of the State, under the responsibility of those who designate them.

In addition, companies under the scope of Fonafe and EsSalud must exhaust the corresponding legal actions if they obtain arbitration awards contrary to their interests, unless through technical, legal and financial reports they justify the convenience of not having to exhaust said actions, and they must have , in that case, with the proper budget availability for its implementation.
