What can I do if my flight is delayed or suspended?

The end of year holidays are approaching and many Peruvians usually take advantage of the long holiday to take a trip to the interior of the country. In total, there are four days off from Saturday, December 23 to Tuesday, the 26th of the same month, which represent an opportunity to get away from the work routine or share recreational activities with your loved ones.

If my flight is delayed, what should I do?

According to the National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi), when a flight is delayed due to the responsibility of the airline, the latter must inform the causes and actions it will take to solve it. In that sense, depending on the time that has passed, you have the following rights:

  • If the flight delay is more than two hours and less than fouryou can receive a snack and make a phone call.
  • If the delay is more than four hours and less than sixthe airline will offer you a snack, a telephone call and food according to the corresponding time (breakfast, lunch or dinner).
  • If the delay is more than six hours, the airline must provide you with a snack, a phone call, and food as appropriate. Additionally, if you need to spend the night, you have the right to accommodation, as well as transportation to and from the airport. Finally, you can access compensation for the minimum amount equivalent to 25% of the value of the missed journey.

What can I do if my flight is canceled, according to Indecopi?

Indecopi points out that if the flight is canceled, the airline must board the passenger on a substitute trip for the same day or refund the net value of the ticket. If this does not happen, you will have to cover the costs of lodging, food and transportation.

In the event that boarding is denied due to overbooking of tickets, the airline must provide the passenger with travel to their destination on the next flight and if they do not have one, they must facilitate the necessary arrangements for their other boarding. If an agreement is not reached, the user has the right to receive the compensation mentioned in the previous paragraphs.

If the airline refuses to give me compensation, what can I do?

If the airline refuses to provide you with compensation or fails to fulfill its obligations, it could be subject to an administrative sanctioning process and receive fines of up to 450 UIT, equivalent to more than S/2 million. It is worth mentioning that between January 2022 and May of this year, Indecopi imposed 712 sanctions and 1,079 UIT in fines on airlines.
