The Labor and Social Security Commission of the Congress of the Republic approved, by majority, the opinion of Bill No. 00105/2021-CR, which proposes to promote labor rights to organize, collective bargaining and strike.
According to the initiative of Together for Peru, presented by congresswoman Sigrid Bazán, the employer cannot terminate the employment relationship of the workers protected by the union jurisdiction without the prior authorization of a judge.
The lawyer may grant dismissal after evaluating compliance with any of the just causes of dismissal contemplated in article 22 and following of the Single Ordered Text of the Labor Productivity and Competitiveness Law, approved by DS 003-97-TR.
Among other details of the document, the worker can directly join the federation of the branch of activity to which he belongs or, if this does not exist, to the confederation of his option, which will exercise legal representation before the employer and the Authority of the Job.
“We have many special regimes that make labor rights precarious and that have not made companies formal. The informality rate remains the same and, in the case of the pandemic, has increased. There is no direct correlation between this project and those issues that it seeks to link, ”said Bazán.
It should be noted that 96% of the companies in Peru are microenterprises, that is, they do not have established unions. Furthermore, only 5% of workers in the formal private sector are affiliated with a trade union organization.
“Today in the Labor Commission the opinion of our PL was approved, which seeks to implement measures to strengthen the exercise of the fundamental right to freedom of association through the protection of union leaders, among others. Now it is time for approval in plenary session. Our full support for the workers who for years have been persecuted, repressed and harassed for demanding what is just, no more! ”, The legislator highlighted hours later on her Twitter account.
