December 25 and January 1 are holidays in Peru due to the celebrations of Christmas and New Year, respectively. The law states that all employees have the right to paid time off or additional pay if they work during these holidays. The National Superintendence of Labor Supervision (Sunafil) determines the amount that each worker should receive.
The responsible entity stressed that employers who do not comply with granting this additional payment will face financial sanctions. The fines will vary depending on the size of the company: for microbusinesses, the penalty will be from S/1,058 to S/3,128; in the case of small businesses, it will range between S/3,542 and S/35,190; while for companies that are not micro or small, the economic penalty will be in the range of S/12,098 to S/241,638.
How much should I be paid if I work on December 25 and January 1?
According to Sunafil, if an employee works on a holiday without having a substitute day of rest, they must receive three types of payments:
- The remuneration for the holiday, which is already included in your monthly salary.
- The remuneration corresponding to the work performed on the holiday.
- A 100% surcharge on the remuneration corresponding to the work performed.
For example, for a worker who receives S/34.16 per day (with a monthly salary of S/1,025), this figure would be multiplied by three. Thus, the total to be received for working on a holiday would be S/102.50. It is important to note that it is not considered a holiday if the work shift begins on a working day and ends on a non-working day.
If I am on vacation during these holidays, how much should I receive?
In this particular situation, the CCL leader mentioned that people who are on vacation during a national holiday are not entitled to receive additional payment.
