The Congress of the Republic approved by majority the PL°5434-2022 —presented by Adriana Tudela (Avanza País)—with which businesses and influencers will no longer be forced to include their RUC and name or company name in their digital advertising.

It is worth remembering that from January 1, 2024, Sunat was going to require that businesses—or any person that offers any good or service on social networks—present this information, and if not, they would be sanctioned; all of this in the interest of expanding the tax base and promoting formalization. The recent decision of the Plenary Eliminates it.

Adriana Tudela considered that Sunat’s criterion is “absurd” since “affects the freedom of entrepreneurs to promote their products and services and distorts the objective of advertising.”

For example, he mentioned that in some social networks you cannot fit the entire number of a RUC or company name.

“I urge the Executive to publish the Law as quickly as possible, in order to prevent the requirement from coming into effect in the following weeks. The State has to be an ally of the entrepreneur and not create obstacles with confusing and meaningless demands,” he commented. the parliamentarian in X (Twitter).

Tax lawyer Rafo Inurritegui mentions that the only way for the repeal voted yesterday in Congress to come into effect is for it to be promulgated in El Peruano before December 31 in El Peruano.
