Through Supreme Decree No. 280-2023-EF, the Ministry of Economy and Finance made official the restart of the return of contributions to those affected by the failed National Housing Fund (Fonavi).
The return to the Fonavistas will be in charge of the Ad Hoc Commission. This group has a fund of S/2.3 billion. In the first instance, it was expected to have the regulation much sooner so that in the fortnight of December the payment to seniors could begin, but the MEF delayed publishing it.
It is estimated that 2 million older adults will be able to access their contributions again after several years of waiting and even those bereaved by Fonavistas will be able to receive them.
It should be added that the refund of contributions to Fonavi was suspended in 2019 after a ruling by the Constitutional Court and regulatory changes that altered its calculation. Until then, it was difficult to determine the amounts to be returned to the contributors because these were not given via individual accounts but with the general contribution of their employers in entities such as the Banco de la Nación.
When and how will the Fonavi begin to be returned?
Luis Luzuriaga, president of the Ad Hoc Commission, informed The Republic that they will meet as soon as possible “emergency” to facilitate all the formal and technical processes so that the Banco de la Nación opens its doors and receives the Fonavistas.
The MEF adds that with the regulations published this Thursday, December 14, Individual accounts will be created based on information collected from employers and public or private entities on labor contributions between July 1979 and August 1998; and if there is no data from official sources, the supplementary documentation presented by the interested party will be considered.
The Ad Hoc Commission may establish other forms of construction of individual accounts in accordance with the rulings of the TC that are applicable; and the amount to be returned to the Fonavistas will be updated to soles and will appear in the Certificate of Contributions and Rights (CERAD).
