The end-of-year holidays are approaching and many workers in the public and private sectors are waiting to receive an additional payment to their ordinary remuneration. Although some people believe that they are the same economic benefit, the truth is that both the bonus and the bonus are different concepts according to the field in which the worker works.

Which workers receive Christmas bonuses?

The bonus is a job benefit paid to private sector workers twice a year: in July and December. This extra money is equivalent to full remuneration and is given to employees with an indefinite, fixed-term or part-time contract. According to Jorge Carrillo, professor and finance expert at Pacífico Business School, there are more than 4 million people who will be beneficiaries of the December bonus and the total amount that would be paid would be approximately S/10,000 million.

In addition, domestic workers, workers in the port regime and in the agricultural sector have the right to receive this additional amount. Likewise, in the case of small businesses, only half a bonus will be received. In accordance with the law that regulates bonuses, employers must make their payment this Friday, December 15. Otherwise, they will be liable to be sanctioned with a fine that could exceed S/120,000.

It must be remembered that the gratification is not affected by discounts, taxes or social security contributions, and that an extra concept of 9% for EsSalud or 6.75% for the plan of the health-providing entities (EPS) must be added. ).

Bonus 2023: who gets this extra money?

The bonus is a benefit that public sector workers receive in July and December. According to Supreme Decree No. 274-2023-EF, the amount to be delivered one time in this month’s payroll will be S/300 and is granted to the following employees:

• Officials and both employees appointed and contracted under the labor regime of Legislative Decree No. 276, Law No. 29944 and Law No. 30512
• Pensioners dependent on the State who are included in the regimes of Law No. 15117, Decree Laws No. 19846 and No. 20530, Supreme Decree No. 051-88-PCM and Law No. 28091
• University teachers included in Law No. 30220
• Personnel of the Armed Forces and the National Police
• Permanent and temporary workers in the public sector
• The health personnel referred to in paragraph 3.2 of article 3 of Legislative Decree No. 1153
• In the case of workers hired under the CAS labor regime, they will receive a payment of S/300 per bonus.
• For the national teaching profession, the bonus will be calculated in accordance with the provisions of Law No. 29944. Teachers with full working hours are granted an amount no less than that indicated in literal a) of section 7.1 of article 7 of the Public Sector Budget Law for 2023
• Human Medicine and Dentistry interns will receive a bonus payment of S/100, within the framework of what is established in the Second Final Complementary Provision of Emergency Decree No. 016-2020.

How are bonuses and bonuses different?

The main difference between the bonus and the bonus is that the former is aimed at public sector workers, while the latter is only received by private sector employees who are registered on the payroll. The amount received by those who work in public institutions is S/300, according to Supreme Decree No. 274-2023-EF; while the bonus is equivalent to an additional salary added to a bonus of 9% for EsSalud or 6.75% for EPS.

December bonus: what are the requirements to access?

Private sector workers who are on the payroll and those who work in the public sector under the private activity labor regime must meet the following requirements to receive the bonus payment:

• Have worked for a full month in the company, prior to the month in which the bonus is due to be paid. That is, if the payment date is in December, the employee must have worked in November
• Complete your duties during the first fortnight of the months in which the bonus is paid.

How can I collect the 2023 bonus?

According to the rule, workers will be able to access the Christmas bonus payment in their bank accounts, as long as they meet the following requirements:

• Have been working as of November 30 of this year or in use of vacation rest, paid leave or receiving the subsidies referred to in Law No. 26790, Law of Modernization of Social Security in Health
• Have been in the service for no less than three months as of November 30 of this year. If you do not have the aforementioned three-month period, said concept is paid proportionally to the months and days worked.
