The initiative, which is called ‘Law to Modernize the Peruvian Pension System’, adds in the complementary provisions the authorization of withdraw up to S/9,900 (2 UIT) from the AFPs only for members who, until November 31, 2023, do not have contributions credited to their individual capitalization account (CIC), for at least six consecutive months.
In addition, it is specified that the measure is applied until the withdrawal is equivalent to 95% of what was contributed by the affiliate; the remaining 5% would be transferred directly by the AFP to EsSalud. Workers who qualify to access the Early Retirement Regime due to Unemployment may not be beneficiaries of this rule.
Another case in which members will be able to withdraw up to S/9,900 (2 UIT) in a single set, regardless of whether they are contributors or not, is if they suffer from an oncological disease diagnosed by an institution that provides health services (Ipress ).
César Revilla: Reform and withdrawals can be debated separately
For the president of the Economy Commission, César Revilla (Popular Force), uniting the reform and the retirements in a single proposal is a reflection of the responsibility it has regarding the population’s pension future. Likewise, he pointed out that if his colleagues request to debate the issues separately they can present a prior question.
“If in the debate the separation is requested and voted on, it is done. What we have done as a commission is to be as responsible as possible for the entire system and the future of the people, because what (is decided) will affect everyone. in the next 30 years,” Revilla explained to The Republic.

The congressman José Luna Gálvez ( Podemos Perú ) has questioned the decision to limit the right to use the money saved in the AFP accounts to a small group. He stressed that Revilla’s prediction is only a proposal that must still be evaluated in the commission, and that in the debate it can be enriched and modified.
“We are going to fight for the withdrawal of the 4 ITUs (S/19,800) and for everyone. This injustice cannot be allowed; Differentiated conditions cannot be created for Peruvians who are suffering from this brutal recession,” he noted.
