The Transportation and Communications Commission of the Congress of the Republic gave the green light to the opinion that states that the air ticket can be transferred by its holder to another person up to 24 hours before the scheduled flight. This change must be free of charge as long as the contract conditions remain the same.
In this way, the initiative will be submitted to the Plenary Session of Congress for discussion and eventual approval. The proposal modifies the Civil Aeronautics Law, on strengthening the rights of users in passenger air transportation, within the framework of article 65 of the Political Constitution of Peru.
“Likewise, it is proposed that, in all cases, except for unforeseen events or force majeure, the Civil Aeronautical Authority apply the penalty established in the Table of Fines that is approved for this purpose,” specifies the approved substitute text.
The president of the Transportation and Communications Commission, Eduardo Salhuana, explained that the current ruling seeks to establish a balance between the interest of consumers and the exercise of business freedom by airlines, therefore, Facilities are provided so that users can endorse their air travel ticket without demanding any cost from any of the parties..
“Establishing this measure in the civil aeronautics law would facilitate the provision of these services to consumers by large transport companies and this could not be classified as over-legislation if one takes into account the quality of defenselessness that users have when making their respective claims,” said the parliamentarian.
If approved by the Plenary, the Executive Branch, through the Civil Aeronautical Authoritymust adapt the regulations and dictate the corresponding measures to comply with the provisions of this Law, within a period of 30 business days counted from the day following its validity.
