On Thursday, December 9, trade union and collective organizations presented to the Executive a preliminary bill that proposes the elimination of the regime of Administrative Contracting of Services (CAS).
The new proposal is in response to the ruling of the Constitutional Court (TC) that declared the partial unconstitutionality of Law 31131, which establishes provisions to eradicate discrimination in labor regimes.
The initiative, like its predecessor, aims to the incorporation of the more than 500,000 workers hired under the CAS modality to the special labor regimes 276 and 728. Its main difference is the spending initiative.
“In theory, the draft that we have presented has the same figure as Law 31131, only this time being the Executive whoever promulgates it, they do have spending initiative, on that side there would be no problem “, he explains Juan Pacherres of the National Coordinator of CAS Workers.
Congresswoman Isabel Cortez, president of the Congressional Labor Commission, and the CAS workers’ centrals participated in the elaboration of the new proposal.
In detail, the draft proposes that the implementation of the law be financed with the budget of each public entity, authorizing them to make the necessary budget modifications without affecting spending and investment in other sectors.
The regulation seeks to benefit workers who were working under this regime for two continuous years or three discontinuous years as of March 10, 2021.
However, its final review is pending due to the fact that the constitutional Court It has not yet published the resolution detailing the observations to the previous rule.
“We have it working and advanced, but as long as the TC does not issue the final resolution, we cannot do anything,” concludes Pacherres.
